25 Appointment of Commissioner

National Identity Scheme Commissioner

(1) The Prime Minister must appoint a Commissioner to be known as the National

Identity Scheme Commissioner.

(2) It shall be the function of the Commissioner to keep under review the exercise

by the Secretary of State of his powers under this Act to disclose information

recorded in the Register without the consent of the individual to whom it

relates.

(3) It shall be the duty of every official of the Secretary of State.s department to

provide the Commissioner with all such information (including information

recorded in the Register) as he may require for the purpose of carrying out his

function under this Act.

(4) A person is not to be appointed as the Commissioner unless he holds or has

held high judicial office (within the meaning of the Appellate Jurisdiction Act

1876 (c. 59)).

(5) The Commissioner is to hold office in accordance with the terms of his

appointment; and there shall be paid to him out of money provided by

Parliament such allowances as the Treasury may determine.

(6) The Secretary of State.

(a) after consultation with the Commissioner, and

(b) subject to the approval of the Treasury as to numbers,

must provide the Commissioner with such staff as the Secretary of State

considers necessary for the carrying out of the Commissioner.s functions.

Where in Section 25 is the power and budget for the National Identity Register Commissioner to investigate complaints from the public about abuses of power and privacy by petty officials ?
